Digital justice systems promote transparency and accountability in the judiciary, improve public access to the justice system, and expedite court proceedings. Since the COVID-19 pandemic of 2020, the digitalisation of judicial, social, economic and cultural systems has become increasingly entrenched. In particular, companies utilising internet-based AI technologies bear accountability for how they store user data and for privacy and confidentiality rules that do not violate data privacy regulations in the countries where they operate. From the perspective of data confidentiality and human rights, the collection of facial recognition systems and biometric data raises privacy and human rights concerns that cannot be resolved at the national level. Against the backdrop of recent advances in social media, global e-commerce, and legal tech/e-justice, this workshop will examine the extent to which these digital technologies can contribute to building a cross-border legal domain while ensuring the protection of fundamental human rights.
